Why Many People Prefer Professional Help with LPAs

The government provides online forms, but they cannot offer tailored drafting guidance or personal checking when you apply completely on your own.

Common Issues That Can Delay Registration

  • Incorrect Signing Order: Signing names out of sequence can cause registration problems.
  • Invalid Witness Setup: Using someone named in the document as a witness may lead to rejection.
  • Conflicting Instructions: Adding conflicting phrases into preference blocks can cause the application to be sent back for correction.

The Xwills Approach

  • Expert Checking: A trained estate planning professional reviews your attorney arrangements before your final drafts are prepared.
  • Sequence Mapping: We map out who signs, when, and where to help reduce errors.
  • Drafting Support: If a drafting error caused by us leads to an OPG rework request, we will correct and re-issue the documents at no additional drafting charge.

Understanding the Risks of Losing Capacity Without an LPA

If a stroke, illness, or accident leaves a person unable to manage their own decisions:

Account Access Restrictions

Banks may restrict access to accounts, including joint accounts, once they are aware of loss of capacity, making it harder to pay bills and manage finances.

Welfare & Medical Decisions

Medical professionals must follow standard statutory frameworks. Family members do not have automatic authority to make decisions without an LPA or Court order.

Court of Protection Process

Appointing a Deputy later requires an application to the Court of Protection, which can involve significant delays and statutory court fees.

Frequently Asked Questions

Is an LPA drafted by Xwills legally valid for registration?
Yes, an LPA can be prepared without a solicitor, provided it is completed correctly and meets the registration requirements. Our team works under the Society of Will Writers Code of Practice, preparing statutory forms to current professional standards for submission to the Office of the Public Guardian.
What happens if my family situation or assets are complex?
During the initial 15-minute call, we review your situation. If you have highly complex cross-border assets, commercial disputes, or other dependencies that fall outside standard administrative drafting, we will flag this before you decide to proceed.
How long does the drafting process take?
Draft documents are usually finalised and sent for your personal review within a few business days after your phone or secure digital consultation.
